Maryland Hit-And-Run Accidents
Let’s discuss some frequently asked questions regarding Hit-And-Run Accident Law in Maryland.
1. What constitutes a Hit and Run?
A “Hit-And-Run” designation can apply to a rainbow of accident scenarios. In general, what happens is a driver or vehicle hits another car, pedestrian, or piece of property and then flees from the scene before providing adequate disclosure of identifying information.
2. Are all hit-and-run accidents serious?
While all such incidents are illegal, hit-and-runs can range widely in severity. In minor cases, for instance, an individual may ding up someone’s property - for instance hit a parked bicycle or run over sod on someone’s lawn. In such cases, the driver might be hit with a ticket or misdemeanor - particularly if no one was hurt. On the other hand, if a driver seriously injures or kills someone and then flees from the scene, he will likely be charged with a felony crime and could face serious fines and jail time.
3. What are some hit-and-run accident scenarios?
- A driver backs into your car in a parking lot and pulls away without leaving a note.
- A driver runs over your property – for instance drives over your garden - and pulls away without leaving identifying documentation.
- A driver hits your car in traffic and provides patently incorrect/misleading info or provides inadequate documentation and then leaves the scene of the accident.
- A driver commits a serious injury and does not stop to assist the victim or provide info/documentation to the authorities.
4. What kind of documentation should you get from a person who hits you, damages your motorcycle, hits another pedestrian, or otherwise seems likely liable for damages?
Get the person’s name, license plate number, driver’s license number, insurance information, and VIN number. You might also ask for the driver’s contact information. If possible, take pictures of the accident scene and write down your observations as soon as possible after the accident occurs. Assemble documents relevant to the accident in a safe place and make copies.
